Zoning Information

The Huntsville Zoning Code provides information regarding our ten zoning districts.  It includes permitted uses and conditional uses within each zoning district.

All persons considering building a home, business, or any structure should confirm that the proposed use/construction is permitted within the zone being considered.

R-E Residential Estates

This district is intended for application to those areas of the city where it is deemed necessary and desirable to protect farm and ranch lands, as well as the rural residential environment.  It intends to provide open spaces to protect natural areas, floodplains, and watercourses and to provide for single-family development on large lots and parcels.

Permitted Uses:

  • Accessory Buildings & Uses
  • Farms and Ranches (except concentrated feeding operations)
  • Lakes & Drainage Basins
  • Registered & Licensed Child Care Family Homes
  • Natural Areas
  • Single-Family Residences

Conditional Uses:

  • Boarding Stables
  • Parks & Recreational Areas
  • Accessory Dwelling Unit
  • Manufactured Homes (See “Other Useful Zoning Information” section below)
  • Churches

  • Cell Phone Towers

Lot Dimensions:

  • Minimum Area:  2 acres
  • Minimum width at building line:  200 feet
  • Minimum front setback:  30 feet
  • Minimum side setback:  20 feet (street side 30 feet)
  • Minimum rear setback:  25 feet

Other Requirements:

  • One dwelling unit per lot.
  • Two off-street parking spaces required for homes (see code for requirements for other uses).
  • Buildings shall not exceed 35′ in height
  • Each principal structure is to be a minimum of 576 sq. ft. of enclosed and heated living space and shall be on a permanent foundation.
  • Accessory buildings shall have a set back of 5 feet from side or rear lot lines.

R-1 Low Density Residential

This zone is primarily intended for single-family residential areas.

Permitted Uses:

  • Registered Child Care Family Homes

  • Cemeteries
  • Churches
  • Farms, Ranches, & Stables (except concentrated feeding operations)
  • Licensed Child Care Family Home

  • Public Uses and Semi-Public Uses

Lot Dimensions:

  • Minimum Area:  12,000 sq. ft.
  • Minimum width at building line:  90 feet
  • Minimum front setback:  30 feet
  • Minimum side setback:  10 feet (street side 30 feet)
  • Minimum rear setback:  25 feet

Other Requirements:

  • One dwelling unit per lot.
  • Two off-street parking spaces required.
  • Buildings shall not exceed 35′ in height.
  • Each principal structure is to be a minimum of 1000 sq. ft. of heated and enclosed living area and on a permanent foundation.
  • Accessory buildings (ex. sheds) shall have a minimum set back of 5 feet, and shall be located only in the rear area or in side yard behind the building line.

R-2 Medium Density Residential

This district is intended to be comprised of single-family structures, including manufactured homes and duplexes.

  • Minimum side setback:  10 feet (street side 20 feet)
  • Minimum rear setback:  25 feet

Other Requirements:

  • One dwelling unit per lot.
  • Two off-street parking spaces required.
  • Buildings shall not exceed 35′ in height.
  • Each principal structure is to be a minimum of 576 sq. ft. of heated and enclosed living area and on a permanent foundation.
  • Accessory buildings (ex. sheds) shall have a minimum set back of 5 feet, and shall be located only in the rear area or in side yard behind the building line.

R-3 High Density Residential

This district is intended for single and multi-family dwellings, not to exceed 12 units per acre.

  • Minimum Area:  9,000 sq. ft.
  • Minimum width at building line:  70 feet
  • Minimum front setback:  25 feet
  • Minimum side setback:  10 feet
  • Minimum rear setback:  20 feet

Other Requirements:

  • One dwelling structure per lot.
  • Two off-street parking spaces are required for each residential dwelling unit.  For other uses, see requirements on pg. 154.1 of code below.
  • Buildings shall not exceed 35′ in height, nor exceed 2.5 stories.
  • Each principal structure is to be a minimum of 576 sq. ft. of heated and enclosed living area on a permanent foundation.
  • Accessory buildings shall have a set back of 5 feet.
  • Residences may be built (or manufactured homes placed) on lots previously platted to the adoption of this code which are less than 9,000 sq. ft., but must be a minimum of 6,000 sq. ft., provided all setbacks can be met and adequate sanitary facilities exist.

C-1 Central Business District

C-2 General Commercial

I-1 Light Industrial

Dual Use Zone shall be located along major thoroughfares accessing the Central Business District as depicted on the Zoning Map.  These zones combine the characteristics of zones C-2 and R-1, to permit commercial growth in what is currently occupied by residential uses.  Permitted and conditional uses for either zone shall apply to the DUZ zone.

I-2 General Industrial

Description:

  • This district is intended for the more intensive industries, and those manufacturing facilities making products from raw materials.  Such uses are intended to be environmentally compatible with commercial and agricultural uses.

Agricultural

This is intended for areas of the city where it is deemed to allow agricultural uses in area of the city which should remain in agricultural use until other urban uses are planned and streets and utilities are either extended or have been bonded for development.

Dual Use Zone

Dual Use Zone shall be located along major thoroughfares accessing the Central Business District as depicted on the Zoning Map.  These zones combine the characteristics of zones C-2 and R-1, to permit commercial growth in what is currently occupied by residential uses.  Permitted and conditional uses for either zone shall apply to the DUZ zone.

A-P – Airport Zone

This district is intended for application to those areas of the city which are used as an airport and to provide open spaces to protect natural areas, flood plains, and watercourses, and additionally to provide single family residences.

Permitted Uses:

  • Airport Hangars with Apartments
  • Accessory Buildings & Uses
  • Single-Family Residences

Conditional Uses:

  • Parks & Recreational Areas
  • Public Uses & Semi-Public Uses

*Similar uses deemed by the Planning Commission to be consistent with the basic intent of this district and which are equal to or less intense than uses may be permitted in this district.

Lot Dimensions:

  • Minimum Area:  1/2 acre
  • Minimum width at building line:  100 feet
  • Minimum front setback:  40 feet
  • Minimum side setback:  20 feet (street side 30 feet)
  • Minimum rear setback:  25 feet

Other Requirements:

  • Two off-street parking spaces are required for hangar.
  • Building height is subject to FAA guidelines.
  • Accessory buildings shall have a set back 5′ from rear or side lot line.

Manufactured homes are to be permitted in zones R-2 and R-3, and may be permitted in zone R-E as a conditional use if reviewed and approved by the Planning Commission.  A Conditional Use application must be filed in the office of the City Clerk (see form here).

Requirements:

  • 576 sq. ft. enclosed, heated living area
  • Must be placed on a permanent concrete or masonry curtain wall foundation, unpierced except for ventilation and access, which may include a walk-out basement or garage.
  • Must meet lot setbacks, found here, based upon the lot’s zoning designation. 
  • Minimum entrance landing area of 5 sq. ft.
  • All running gear, tongues, axles, and wheels must be removed at installation.
  • Traditional siding and roofing materials customarily used in home construction are required (see exact details in Title 14, pg 153, below).
  • Attached additions and detached garages must comply with building code.
  • Prior to issuance of a permit, evidence shall be presented to Code Enforcement Official that the dwelling unit was constructed in accordance with the federal (HUD) standards and meets the definition set forth in A.C.A. 20-25-102.

Includes but not limited to: garages, carports, parking/driveways, sheds, patios, gazebos, cabanas, playhouses, residential recreational/play facilities, storm shelters, home occupations and accessory dwelling units (see more below).

  • All accessory structures, including detached garages, sheds, fences, and walls, shall be maintained structurally sound and in good repair.
  • Placement
    • Use zoning map above to determine your zone.
    • R1, R2, & R3 –  shall be located in the rear or side yards behind the building line.
    • ALL ZONES – 5 feet from side and rear lot lines.
    • On corner lots, structures must be placed in non-street side yards or rear areas.
    • Must be 10 feet away from principal structure.
    • If attached to principal structure, it must be made to be part of the principal structure, sharing a common wall, and must comply with applicable building requirements, including building setbacks.
    • Must not be located within utility easements or over any known utilities or sewer lines.  Have utilities marked by calling 811 in Ark.
    • Carports – detached, open-sided carports may be located in the side yard, no closer to the front lot line than the home, and side setbacks must be met (10′ for zones R1, R2, and R3, and 20′ for RE.  See zoning map HERE).
  • Size Restrictions
    • May not occupy more than 20% of total lot area (square footage), or more footage than is covered by the principal structure.
    • Must not exceed 12′ in height, measured from highest point for residential.  Commercial accessory structures may not exceed 25′ or height of principal structure.
  • Building Permit Requirements
    • Requires a building permit application if it will contain plumbing or electrical components and/or is to be placed on a permanent slab foundation.

The following rules apply to recreational vehicles, all-terrain vehicles, boats, and trailers of all kinds in any residential district:

  • It is unlawful to park the above on any kind in the front yard unless it is parked on a driveway or paved surface (defined as concrete, asphalt, gravel, or brick) immediately adjacent to and an expansion of the driveway.
  • It shall not be parked closer than 10′ of the paved edge of any street.
  • No more than 3 total may be parked on any property.
  • May be parked in side or rear yards no closer than 5 feet of property line.  On corner lots, none shall be stored on side yard bordering a street.
  • No parking on public street, unless being loaded, unloaded, or readied for use, never to exceed 24 hours.
  • It is unlawful to park any of the above in a public park.
  • Shall not be parked in a manner to be a vehicular hazard.

  • No parking shall be allowed in front yard areas of a residence.
  • Vehicles parked in driveways must not block sidewalks, where applicable, and must not create an obstruction to visibility.
  • All inoperable vehicles must be parked in an entirely enclosed space, garage, or carport, other than in cases of emergency. 
    • Inoperable definition:  engine or motor is inoperable, any wheel(s) removed, flats on 2 or more tires, major components are missing, vehicle does not have a current AR registration.
    • No inoperable vehicle shall be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled for a period or more than 60 days.  (International Property Maintenance Code adopted by Ordinance 2015-1.)

  • Fences shall not exceed 8′ in height.
  • Support posts are to face the inside of the fenced area, except in cases where fence is facing a non-residential district.
  • All fences shall be maintained in their original upright condition.  Fences designed to be painted or have other surface finishes shall be maintained in their original condition. 
  • Missing boards, pickets, or posts shall be replaced or repaired in a timely manner.
  • With the exception of galvanized steel, all exposed steel must have a color finish coat applied to prevent rust and corrosion.
  • Barbed wire and electrified fences are prohibited on all lots less than two(2) acres.
  • On corner lots at intersecting two-way-streets, nothing shall be erected, placed, planted, or allowed to grow that will impede vision between 2′ and 8′ above curb grade.  The distance from the corner to the fence/hedge will be marked by our street dept: please call 479-738-6607.  Must allow for utility setbacks.
  • No building permit is required.

It is illegal for any person to dump, deposit, throw, place or in any manner leave or abandon any solid waste, including but not limited to, garbage, cans, bottles, rubbish, refuse, furniture, appliances, or trash upon any property inside the city limits.

PLANNING COMMISSION

The City of Huntsville Planning Commission meets on the 4th Monday of the month at 6:00 p.m. at City Hall.  The Planning Commission also serves as the Board of Zoning Adjustment.  The Commission is charged with development of the Zoning Code, hearing all requests for changes in the code and zoning designations, and requests for conditional uses in a zone.  An application must be submitted to the Commission for any changes to be considered.  The applications may be printed below or obtained in the office of the City Clerk.  A non-refundable fee of $50 is required for each application before it will be considered by the Commission.

Applications

All requests for zoning changes require a public hearing. At a minimum of 15 days prior to the hearing, a public notice must be published in a newspaper of general circulation in the city at the expense of the applicant, stating the time, place, and subject of the public hearing. Normally, this application must be filed by the first business day of the month to insure a hearing at the regular scheduled meeting of the Commission. The findings of the Commission must be subsequently approved by the City Council.

The applicant understands that he/she is responsible for sending a notice of the public hearing to all owners of adjacent properties. The notice to all adjacent property owners must be sent by certified mail, return receipt requested at least fifteen (15) days prior to the Planning Commission meeting. The applicant or official representative must be present at the meeting in order to answer questions the Commission members or interested parties may have.

Applications shall be returned to the City Clerk’s office, along with the $50 application fee.

Refer to City Zoning Code beginning on page 134 to see list of conditional uses allowed for each zoning district.  This application must be accompanied by graphic representation showing the location and proposed use of the site, along with such other descriptive material necessary for decision making by the Planning Commission.  Such may include, but are not limited to: preliminary site plans showing proposed uses and structures; proposed ingress and egress to the site, including adjacent streets; proposed off-street parking and landscaping; lighting and signage; a preliminary plan for provision of sanitation and drainage structures, etc.  Failure to supply the Commission with necessary information will delay consideration of this application.

The Huntsville Planning Commission meets on the 4th Monday of each month.  All conditional use requests require a public hearing.  At a minimum of 15 days prior to the hearing, a public notice must be published in a newspaper of general circulation in the city at the expense of the applicant, stating the time, place, and subject of the public hearing.

The applicant shall present evidence that an owner of each parcel of land or business within 200 feet of the exterior boundaries of the subject property have been notified  of the proposed uses, and of the time, date, and place of the public hearing.  Such evidence shall consist of certified mail receipts and/or return receipts and/or dated, signed acknowledgments of receipt of notification if personally delivered.

Applications shall be returned to the City Clerk’s office, along with the $50 application fee.

The Board of Zoning Adjustment may only hear requests for variances in instances where strict enforcement would cause undue hardship due to circumstances unique to the individual property under consideration, and grant such variances only when it is demonstrated that such action will be in keeping with the spirit and intent of the provisions of the City of Huntsville Zoning Code. The Board of Zoning Adjustment shall not permit, as a variance, any use in a zone that is not permitted in that zone. The Board may impose conditions in the granting of a variance to insure compliance and to protect adjacent property.

The Board of Zoning Adjustment can issue approval of a variance only after finding that:

  1. Special conditions and circumstances exist which are peculiar to the land, structure, or building.
  2. Literal interpretation of the provisions of the Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the Code;
  3. The special conditions and circumstances do not result from the actions or proposed actions of the applicant; and
  4. Granting the variance requested will not confer on the applicant any special privilege that is denied by the Code to other lands, structures, or buildings in the same district.

  • Vehicles parked in driveways must not block sidewalks, where applicable, and must not create an obstruction to visibility.
  • All inoperable vehicles must be parked in an entirely enclosed space, garage, or carport, other than in cases of emergency.  *See Title 14 page 154.1.
    • Inoperable definition:  engine or motor is inoperable, any wheel(s) removed, flats on 2 or more tires, major components are missing, vehicle does not have a current AR registration.  *See Title 8, pages 67-68.

  • Fences shall not exceed 8′ in height.
  • Support posts are to face the inside of the fenced area, except in cases where fence is facing a non-residential district.
  • All fences shall be maintained in their original upright condition.  Fences designed to be painted or have other surface finishes shall be maintained in their original condition. 
  • Missing boards, pickets, or posts shall be replaced or repaired in a timely manner.
  • With the exception of galvanized steel, all exposed steel must have a color finish coat applied to prevent rust and corrosion.
  • Barbed wire and electrified fences are prohibited on all lots less than two(2) acres.
  • On corner lots at intersecting two-way-streets, nothing shall be erected, placed, planted, or allowed to grow that will impede vision between 2′ and 8′ above curb grade.  The distance from the corner to the fence/hedge will be marked by our street dept: please call 479-738-6607.  Must allow for utility setbacks.

It is illegal for any person to dump, deposit, throw, place or in any manner leave or abandon any solid waste, including but not limited to, garbage, cans, bottles, rubbish, refuse, furniture, appliances, or trash upon any property inside the city limits.

  • No inoperable vehicle shall be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled for a period or more than 60 days.  (International Property Maintenance  Code adopted by Ordinance 2015-1.
